Terms of Service

Last updated 12 October 2026

These terms govern your use of Kistorium. Please read them alongside our Privacy Policy. By creating an account or using the service, you agree to these terms.

1. Parties, acceptance, and eligibility

These terms are a contract between you (and, if you use Kistorium on behalf of an organisation, that organisation) and Kistorium Limited (New Zealand company number 9442772). You accept them by creating an account or using the service. You must be at least 18 years old to create or hold an account. Anyone may view a guide that an account holder shares with them.

2. The service and the Kist model

Kistorium turns screen recordings, or steps you type, into narrated video tutorials and step-by-step guides. Work is organised into Kists. A Kist has Admins and can have members with different roles. The customer that owns a Kist controls the data within it and decides who may access it.

3. Licence and acceptable use

Subject to these terms, we grant you a non-exclusive, non-transferable right to use Kistorium for any lawful purpose, including making guides for your staff, customers, clients or students and sharing them with anyone. Your use must comply with the Acceptable Use Policy below, which forms part of these terms.

4. Acceptable Use Policy

You agree not to use Kistorium to:

  • record any screen, person, or audio that you do not have a lawful right to capture, including any recording that would breach two-party or all-party consent laws that apply to you or to a person who is recorded;
  • capture another person's credentials, payment data, health data, or other sensitive information without a lawful basis;
  • present AI-generated content in a way that deceives others, for example passing synthetic narration off as the real voice of a named person;
  • pretend to be another person or business, or present a guide as coming from a business you do not represent;
  • upload or process content you do not have the right to use, or that infringes someone else's rights;
  • distribute malware, attempt to gain unauthorised access, scrape, or reverse engineer the service, or otherwise abuse or disrupt it.

You must obtain any consents required from people who appear in or are heard in your recordings. Before each recording, close windows that contain other people's data, credentials, or sensitive information.

5. Your content and your responsibilities

You are responsible for the content you record and upload. You warrant that you have the right to capture what you record, including any consent required from people who appear in or are heard in a recording, and that you will not capture content you are not entitled to. This is an important basis on which we provide the service to you.

6. Intellectual property

We own the Kistorium platform and all rights in it. You own your content and the guides generated from it. You grant us the limited rights needed to host and process your content in order to provide the service to you (including sending it to the sub-processors described in our Privacy Policy).

7. AI-generated output

The steps and narration Kistorium produces are generated by AI and may contain errors. The pictures in your guides come from your own recording or from pictures you add. They are not made by AI. You should review outputs before relying on or publishing them, and you are responsible for how you use them. Some third-party AI providers offer their own terms covering generated output, which may apply to that output.

8. Fees, purchases, and taxes

Kistorium is sold as one-off purchases, not subscriptions. When you buy a pack for a Kist, everything it includes is added to that Kist. It does not expire and does not reset, but it stays with that Kist: if the Kist is deleted, any unused balance is lost, and it cannot be moved to another Kist. Nothing renews, and there is no recurring charge. Every Kist also has a free allowance at no cost. The first pack a Kist buys also adds the bonus video guides shown on that pack, once for each Kist. If a Kist completes a pack purchase before our launch offer ends (the end of 28 February 2027, New Zealand time), that Kist keeps paying the launch price for every pack we still sell. If a new Kist is created through another Kist's referral link, then when the new Kist completes its first pack purchase, each of the two Kists gets three extra video guides, once. This does not apply to a Kist referring itself, another Kist of the same business, or a purchase made with a card the referring Kist has paid with. Apart from that, we may change prices on reasonable notice, and a change applies only to purchases made after it takes effect, never to a pack you have already bought. Prices are in New Zealand dollars, and New Zealand dollars is what you are charged. The amount shown at checkout is the amount you are charged; we do not add anything to it. If your card is issued in another currency, your bank sets the exchange rate. Payments are processed by Stripe.

9. Refunds

There is nothing to cancel, because nothing renews: no charge repeats, and no notice period applies. Except where the law requires otherwise, fees already paid are non-refundable, and a pack is non-refundable once purchased. What a pack adds to a Kist does not expire and does not reset, but it stays with that Kist: if the Kist is deleted, any unused balance is lost, and it cannot be moved to another Kist. Nothing in these terms limits rights you have under consumer law that cannot be excluded, including, for New Zealand consumers, the Consumer Guarantees Act 1993 and the Fair Trading Act 1986.

10. Warranties and disclaimers

Except as expressly stated and to the extent permitted by law, the service is provided “as is” without warranties of any kind. We do not warrant that the service will be uninterrupted or error-free, or that AI-generated output will be accurate. This clause does not exclude guarantees that cannot lawfully be excluded, including under the New Zealand Consumer Guarantees Act where it applies.

Our guarantee. If a video guide Kistorium made from your recording is wrong or faulty, contact support and we will refund the video credit it used to that Kist’s balance. This refunds the credit, not money, and we decide whether a guide is wrong or faulty by looking at it and the recording it was made from. It does not change section 9 or the paragraph above.

11. Limitation of liability

To the maximum extent permitted by law, neither party is liable for indirect, incidental, or consequential losses, and our total liability arising out of or in connection with the service is limited to the amount you paid us in the 12 months before the event giving rise to the claim. Nothing in these terms limits liability that cannot be limited by law.

12. Indemnities

You will indemnify us against claims and losses arising from your unlawful recording, from content you had no right to capture or use, or from your breach of the Acceptable Use Policy.

13. Suspension and termination

You may stop using Kistorium at any time. You can close your account yourself and choose Delete my account in Settings. The screen shows what is deleted and what is kept before you confirm. The person who created a Kist can also delete just that Kist in Settings. We may suspend or terminate access if you materially breach these terms or use the service unlawfully. On termination we will give you a reasonable window to export your content, after which we will delete it in line with our retention practices.

14. Changes to these terms

We may update these terms from time to time. We will change the “Last updated” date above and, for material changes, take reasonable steps to let you know. Your continued use of the service after a change means you accept the updated terms.

15. Governing law and disputes

These terms are governed by the laws of New Zealand, and the New Zealand courts have jurisdiction over any dispute, without affecting any mandatory consumer-protection rights you have in your own country.

16. Privacy and Data Processing

Our Privacy Policy forms part of these terms. If your business needs a Data Processing Agreement, email support@kistorium.com and we will put one in place.

For the recordings and guides in your Kist, we act only as your service provider: we hold and process them for you, on your instructions, and not for our own purposes. Under section 11 of the New Zealand Privacy Act 2020, that information is treated as held by you. You are responsible for telling people who appear in your recordings about it where privacy law requires, including under Information Privacy Principle 3A.
